IY LEGAL has won another LCIA Arbitration for a commodity trading client. The case concerned the sale of RB3 coal to be shipped from South Africa to India in 2020, on SCoTA Version 8 terms. The dispute between the parties involved issues of contract formation, the validity of the arbitration agreement, force majeure/frustration and non-performance by the Buyer, allegedly due to the effects of COVID 19. The Arbitration proceeded to a full oral hearing (held virtually) before a Tribunal of 3 Arbitrators. IY LEGAL’s client succeeded on all issues and was awarded 100% of its claim.
